As many of you know, the AUSA has hauled me into federal court (at the behest of EOIR) for silently looking at my lap in the back row of immigration court while observing a hearing.
Details: While I was silently sitting in the back row of court last summer, the security guard told me repeatedly to stop using my phone. However, I ignored her since I had to answer urgent messages from my office, and the EOIR Security Directive (above) allows attorneys to use their electronic devicees for work purposes. The judge later claimed that he had directed the security guard to tell me that. I have no idea whether or not that's true, but my impression at the time was that if the judge had wanted me to turn off my phone, he would have said so directly to me and not passed messages through a security guard. Regardless, the directive says that the judge can only prevent an atty from using her phone for business related activities if it poses a disruption, which I was not doing under any definition of «disruption.»
Please consider joining me at the trial. Having a lot of people there will help show the judge that the community is against this sort of bullying. Please wear any shade of blue in solidarity.
